These Terms of Service (these “Terms”) govern your access to and use of the website, www.popyourvitamins.com (the “Website”), operated by Pop Your Vitamins., LLC d/b/a Pop Your Vitamins™, a Colorado limited liability company (“Company,” “we,” or “us”). The Website and all related content, tools, and features offered on or through it are collectively referred to as the “Services.”

By using the Services, you agree to these Terms. Please read carefully, as they contain important information about your legal rights. If you do not agree, do not use the Services.

2. Orders for Products

(a) Payment

You may purchase our beverages and related products (“Offerings”) through the Services. You agree that all information you provide for purchases is accurate, current, and complete. You represent you are authorized to use the payment method you provide.

(b) Promotional Codes

From time to time, we may issue promotional, referral, or discount codes (“Promotional Codes”). These must be used lawfully, for their intended purpose, and may not be resold or transferred. They are not redeemable for cash unless required by law.

(c) Subscriptions

If we offer recurring subscriptions, your payment method may be billed automatically at the start of each subscription period until canceled. You may cancel in accordance with instructions provided.

(d) Order Acceptance & Shipment

Receiving an order confirmation does not constitute acceptance. We may refuse or cancel any order at our discretion. Title and risk of loss transfer to you once we deliver your order to the carrier.

10. Disclaimers & Limitation of Liability

The Services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied.

To the extent not prohibited by law, Pop Your Vitamins™ and its affiliates are not liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the greater of $100 or the amount you paid us in the past six (6) months.

 

 

11. Indemnification

You agree to indemnify and hold harmless Pop Your Vitamins™, its affiliates, officers, and employees from any claims, damages, or expenses related to your use of the Services or violation of these Terms.

 

 

12. Additional Provisions

  • SMS & Email Marketing: By providing your contact info, you agree we may contact you with updates or offers (if you opted in). You may unsubscribe anytime.

  • Updating Terms: We may revise these Terms from time to time. Updates are effective upon posting.

  • Termination: We may suspend or terminate your access for violations. Provisions that should survive termination (e.g., liability limitations) will remain in effect.

 

 

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law rules. Any disputes will be resolved exclusively in the state or federal courts in Denver County, Colorado. You waive the right to a jury trial to the fullest extent permitted by law.
